Terms of service

By using FireVM’s services, you agree to the terms below. Please read them carefully, since they explain what you can and cannot do on our platform, what we guarantee, and what happens if something goes wrong.

1. Server security and abuse

We prohibit any activity intended to compromise, disrupt, or gain unauthorized access to FireVM systems or other customers’ accounts, including:

 

  • Intercepting or misappropriating data belonging to others
  • Probing, scanning, or testing systems for vulnerabilities
  • Accessing an account or server you are not authorized to use
  • Distributing viruses, worms, trojans, or similar malicious code
  • Bypassing or tampering with authentication or security controls
  • Attempting to access data or services not intended for you
  • Disrupting service through flooding, overload, or similar attacks

You are responsible for all activity on your account, regardless of who carries it out.

2. Billing and renewals

New accounts are billed on the day the order is placed. Renewals are billed one day ahead of your next billing cycle to avoid any interruption in service.

3. Adult content policy

FireVM does not permit hosting of pornography or sex related merchandise, nor does it allow hosting or linking to explicit nude content from any FireVM account.

 

This does not extend to adult oriented sites that contain no explicit nudity and do not sell sex related merchandise, such as adult dating platforms or nightlife listing sites. These remain permitted.

4. Inode limits

Shared hosting accounts are capped at 200,000 inodes per hosting account. Exceeding this may result in your account being flagged for review or suspension. Dedicated servers have no inode limit, so accounts regularly near this cap should consider upgrading.

5. Governing law and jurisdiction

These terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising from these terms or your use of FireVM’s services will be resolved exclusively in the state or federal courts located in Delaware, and both parties consent to that jurisdiction.

6. Email and anti spam policy

We take a strict stance on unsolicited email and spam related activity:

 

  • We do not permit accounts affiliated with entities listed on the Spamhaus ROKSO database.
  • Sending unsolicited email from any FireVM account or server is not permitted. We determine what qualifies as spam at our discretion, including opt-in and opt-out mail campaigns tied to domains hosted with us.
  • ShoutCast servers are not supported due to their bandwidth demands.
  • Harvesting email addresses without the owner’s consent is not allowed.
  • IP blacklisting: If your account’s IP address becomes blacklisted, typically due to spam, hacking, or phishing activity, we may suspend or terminate your service without prior warning or refund. We check blacklist status using tools such as MxToolbox and multirbl.valli.org.
  • Mass commercial mailing is not permitted, even where recipients have opted in, including double opt-in lists.
  • Distributing or facilitating tools designed to violate this policy, including bulk mailers, ping floods, or denial of service tools, is prohibited.
  • Mailing lists must be confirmed opt-in. Every address on a list must have explicitly verified their subscription, and proof of that confirmation should be kept on file for as long as the list exists.
  • Purchasing third party contact lists for use with a FireVM hosted domain is not allowed.

7. Backup and hosting control panel access

Backup tools and hosting control panel access are provided as a convenience, not a guarantee. You’re responsible for maintaining your own backups at all times. FireVM is not liable for data loss under any circumstances, and the control panel itself is a third party product not affiliated with FireVM.

8. Free domain promotion

When a free domain promotion is active, FireVM will register one eligible domain (.com, .net, .biz, .info, .name, .us, or .org) at no charge for new accounts. This applies to new signups only and covers the first year of registration; renewals are billed at standard rates.

9. Resource usage

Published resource limits apply to all hosting accounts. If your account exceeds them, we will notify you and give you a reasonable window, currently 7 days, to investigate and resolve the issue. If the overage continues unresolved beyond that window, your account may be suspended, and continued non-resolution may lead to termination along with an overage fee reflecting the impact on our infrastructure.

10. Prohibited content and services

The following are not permitted on any FireVM account, whether hosted directly or linked to from a FireVM hosted site:

 

  • Sites distributing hacking tools or services
  • Ponzi or pyramid scheme operations
  • Content promoting racism, violence, or hate
  • Adult content sites
  • Any form of child exploitation material
  • Warez or pirated software repositories
  • Torrent trackers or P2P file sharing tools
  • HYIP platforms, HYIP monitors, or unregulated e-currency exchanges
  • Carding forums or card fraud tools
  • Distribution of copyrighted music or media you do not own the rights to
  • Phishing pages or fraud related content
  • Unlicensed banking or financial services
  • Proxy or tunneling scripts
  • Hacking tools, exploits, or archives of either
  • PHP shells or web shells
  • Sites distributing unlicensed or pirated software
  • IRC based tools or software
  • Game server software, including dedicated game servers

FireVM determines, at its own discretion, whether content violates this policy. Non-compliant content may be removed without advance notice.

11. Non-payment: suspension

  • Dedicated servers are suspended if payment is not received by the invoice due date.
  • A reactivation fee of up to $50 may apply to restore a suspended account.
  • All other services are suspended if payment is not received within 2 days of the invoice due date.

12. Non-payment: termination

If an invoice remains unpaid beyond the grace period, 1 day for dedicated servers, 14 days for everything else, the account is terminated and its data permanently deleted. We do not retain backups of terminated accounts.

13. Media storage limits

Shared hosting accounts may store up to 5GB combined of media files such as music and video. If you need more, our VPS or dedicated server plans are built for that.

14. Chargebacks

If we receive a chargeback from your card issuer or PayPal, your account is terminated immediately without further notice, and its data is permanently deleted without backup.

15. Acceptable use

FireVM services are provided for lawful purposes only. You may not use our servers or network to transmit, store, or host any content or data that violates applicable United States federal, state, or local law. This includes, without limitation, content that infringes copyright, contains threats or obscene material, jeopardizes national security, or violates trade secret protections.

 

By opening an account with FireVM, you agree to indemnify us and hold us harmless from any claim arising out of your use of our services that causes harm to another party.

16. Domain transfers

FireVM is not responsible for handling domain transfers out of our platform. It’s the account holder’s responsibility to coordinate the transfer with the destination registrar.

18. Network and connection restrictions

FireVM does not permit the following activity on its network:

 

  • Operating proxy servers of any kind, for personal or commercial use
  • Scanning ports on our network or infrastructure, whether inbound or outbound
  • Running IRC servers, bots, bouncers, or related background processes

19. Email storage limits

The same 5GB combined limit applies to email and attachment storage on shared hosting accounts. Accounts needing more space should move to VPS or dedicated hosting.

20. Service availability

We aim to keep our services online and accessible 24/7. From time to time, downtime may occur due to scheduled maintenance, infrastructure upgrades, or events outside our control, such as network attacks or upstream provider outages. Where maintenance is planned, we will give at least 48 hours notice in advance. We are not responsible for downtime caused by actions taken on your own account.

21. Cancellations

To cancel an account, we require proof of ownership, such as partial billing details or your account’s billing password. An email address or billing address alone isn’t sufficient verification. All cancellations must go through our designated cancellation process.

22. Refunds

Our refund policy is published separately on our website. Any violation of these terms voids your eligibility for a refund.

23. Backup usage limits

Shared hosting accounts are not intended for use as a general backup or storage destination. One hosting control panel backup of your own account is permitted; storing repeated or redundant backups is not.

24. Limitation of liability

FireVM’s total liability for any claim related to our services is limited to the amount you paid us for the affected account in the billing period immediately before the claim arose.

25. Background processes

We ask customers to check with us before running any persistent background process that consumes significant server load. Processes that run without this approval may result in account suspension or termination at our discretion.

26. Support response commitment

We aim to give every technical support ticket an initial human response within 1 hour, 24 hours a day. This commitment applies to technical support only, not sales, billing, or marketing inquiries. During major incidents, such as hardware failure or a network wide outage, response times may extend as our team focuses on resolving the issue for all affected customers. We post updates on major incidents as they’re resolved.

27. File hosting restrictions

Shared hosting accounts should not be used as a public file download server or as a transloading service. If you need to distribute large files externally, please use infrastructure built for that purpose.

28. General terms

  • Anything not explicitly addressed here is subject to FireVM’s interpretation and discretion.
  • FireVM may update these terms at any time without prior notice.
  • We reserve the right to terminate any account with 15 days notice, for any reason.
  • These terms form a binding agreement between you and FireVM once your account is active.
  • Our refund guarantee applies to shared hosting only, and does not extend to domains, dedicated IPs, SSL certificates, or similar add-ons.
  • Violating these terms may result in immediate account termination.
  • Except for our refund guarantee, all fees are final and non-refundable.
